Short Term Rental Information

In order to preserve and enhance the character of the communities and promote the public health, safety, and general welfare, the City of Deadwood expressly prohibits transient commercial use of residential property for remuneration, which uses are inharmonious with and injurious to the preservation of the residential character and environment of the City.

Deadwood City Ordinance Chapter 17.53 TRANSIENT COMMERCIAL USE OF PROPERTY--PROHIBITED 

This ordinance shall not apply to transient commercial use of residential property for remuneration for a period of fourteen (14) days or less during the month of August, commencing four days immediately preceding the official start of the Sturgis Motorcycle Rally and ending three days after the end of the Sturgis Motorcycle Rally each year.

Short Term Rentals are defined as Bed and Breakfast Establishments, Specialty Resorts, and Vacation Home Establishments. 

• Bed and Breakfast Establishments are allowed in the residential areas with an approved Conditional Use Permit.
• Specialty Resorts are only allowed in the commercial and commercial highway zoning districts with an approved Conditional Use Permit.
• Vacation Home Establishments are only allowed in commercial and commercial highway zoning districts with an approved Conditional Use Permit.

All approved Conditional Use Permits are  required to meet the following requirements and are reviewed on an annual basis by the Deadwood Planning and Zoning Commission and Board.

• Proof of South Dakota State Excise Tax through the Department of Revenue provided to the Planning and Zoning Office for their files.
• Proof of Lodging License from the South Dakota Department of Health provided to the Planning and Zoning Office for their files.
• Proof of enrollment into Business Improvement District Tax 1 - 6. Please contact the City Finance Office for assistance  (605) 578-2600 Ext 5.
• Obtain City of Deadwood Business License .
